One of my favourite quotes by Ludwig von Mises. The truth of this quotes has been confirmed in every debate with adherents of socialism. 

I know only too well how hopeless it seems to convince impassioned supporters of the Socialist Idea by logical demonstration that their views are preposterous and absurd. I know too well that they do not want to hear, to see, or above all to think, and that they are open to no argument. But new generations grow up with clear eyes and open minds. The Chimera of Efficiency (Part 1)

The judicial decision-making takes place in three phases. First, every judge must acquaint himself with the facts of a particular dispute and decide which of them are relevant for rendering the decision. He then must determine which legal norms are to be applied and interpreted. The interpretation of legal norms may however lead to different or even contradictory outcomes. Where does the economic analysis of law stand in all that? The law and economics approach dictates that the judge should decide the case on the basis of cost-benefit analysis so as to maximize societal wealth.

...but no so soon. First I could introduce myself a little. I am a student of law at Charles University in Prague, Czech Republic, but currently I'm studying at the University of Ghent in Belgium. I'd like to say a few words about my interests. I'm interested in legal philosophy (discussion between natural law and legal positivism, economic analysis of law), legal theory (torts), Austrian economics (especially methodology) and ethics (virtue ethics plus metaethics). 

Fundamentals of Economics on Youtube

Of late, I've been listening to series of lectures on fundamentals of economic analysis on youtube. Here are some of the lectures which I find most interesting.

Je lidské jednání racionální? Ano, vždy.

Co je to lidské jednání? Definici najdeme např. v knize Lidské jednání (Human Action) Ludwiga von Misese. Podle něj (a dalších představitelů rakouské školy) je lidské jednání účelové chování. Jako takové stojí v protikladu k lidským reflexům. Lidské jednání slouží k dosažení cílů, které si lidé stanoví/vyberou. K tomu, aby dosáhli svých cílů, musí použít jistých prostředků. Tak například jestliže je naším cílem sledování filmu v kině, musíme si k tomu vyhradit čas, musíme si koupit vstupenku, musíme se nějakým způsobem do kina dostat, atd. Jednáme proto, že máme potřebu, resp. pocit určitého strádání. Kdybychom nestrádali, lidské jednání by se nikdy nekonalo. To je také důkazem toho, že jsme nedokonalé bytosti. Dokonalé bytosti nestrádají, proto nejednají. (Že by důkaz boží neexistence?) Lidské jednání vždy směřuje do budoucnosti. 

Čtení na léto

Tak a je tady první příspěvek. Nečekejte však nějaké filozofování. Během léta bych rád dohnal to, na co jsem poslední dva roky neměl pořádně čas. Proto Vám představím pár knižních titulů, na něž se v červenci vrhnu. Už teď je mi však jasné, že zdaleka ne všechno přečtu, a tak si budu muset vybírat.

1. Hans-Bernard Schäfer, Claus Ott: The Economic Analysis of Civil Law. Podle Roberta Cootera, odborníka na "právo a ekonomii", se jedná o skvělou knihu. Zatím jsem přečetl jenom první kapitolu, ale můžu říct dvě věci: (i) zdá se, že kniha je napsána srozumitelně, (ii) a že je učebnicí mainstreamového pojetí ekonomické analýzy práva, takže se to jenom hemží společenskou efektivitou a její maximalizací.
